CONCERNED RESIDENTS OF PIONIERSPARK WRITES:This letter is addressed to the Chief Executive Officer, City of Windhoek, and for attention to the Environmental Management Unit and the Windhoek City Police Commander.We, the undersigned residents of Pionierspark residential area, hereby submit this formal petition to request immediate municipal intervention and the restriction of the increasing and severe noise disturbances, without any prior notice, resulting from excessively loud music and blaring broadcasts from live music festivals and commercial entertainment and outdoor events held in our residential neighbourhood.The local sports clubs and commercial properties within our residential area are increasingly hosting the above-mentioned events, starting with blaring audio from early morning till very late at night, causing a great disturbance in our peaceful residential area. A recent example is the Soulection Music Festival held on Saturday, 29 August 2026, which subjected residents to sound testing and broadcasts starting before 9:00 and continuing until midnight.While we support school and sporting activities and standard business operations, the transformation of these venues into commercial entertainment hubs, where the primary attraction is the broadcast and blaring of excessively loud music, has become a significant disruption in our neighbourhood. The constant barrage of loud noises, blaring music and public announcements doesn’t just inconvenience us; it has invaded our homes, disturbing our peaceful family routines and has profound implications for our health and well-being. Pionierspark is a residential neighbourhood with families, young children and the elderly, where this noise pollution is more than just a nuisance; it impedes everyday life and severely impacts the health and mental health of our children, elderly and families. This noise also disrupts the teaching and learning environments of our local schools in the neighbourhood. Finally, this noise not only disrupts our peaceful neighbourhood, but also degrades our property values, affects our quality of life and our right to a peaceful environment.We submit the “Restrict Loud Noise in Residential Areas Petition” under the following applicable legal framework provisions and statutory violations which are currently being violated:– The City of Windhoek Noise Control Regulations: Under these municipal by-laws, Pionierspark is zoned as a single residential area. Sound limits are strictly legally capped at 55dB during the day and 45dB at night. The events hosted by these clubs exceed 70+ dB, breaching municipal law.– The Environmental Management Act (Act No. 7 of 2007): This Act classifies excessive, continuous noise pollution as an environmental crime and a public health hazard that compromises the well-being of a community.– The General Audibility Rule: Municipal regulations dictate that music played within any facility or boundary must not be audible from the street or an adjacent residential property.– Zoning and Land-Use Abuse: These venues operate under sports or institutional zoning. Hosting commercial music festivals violates the Windhoek Town Planning Scheme’s strict boundary definitions for commercial entertainment.Therefore, the residents of Pionierspark urgently demand: – A Complete Ban on Music Festivals and Commercial Events in Residential Areas: An immediate prohibition of permits for these sports and commercial venues hosting music festivals, concerts, or any event where amplified music is the primary attraction.– Audio Boundary Restrictions: Strict enforcement ensuring that any PA systems used for sporting announcements or background audio are completely inaudible beyond the venue’s property lines.– Permit Freeze: An immediate freeze on issuing temporary entertainment licenses or “Sound Broadcasting Permits” to these specific residential-adjacent venues.– Active Law Enforcement: Proactive monitoring by the Windhoek City Police and immediate confiscation of equipment from non-compliant venues under the penal provisions of the Noise Control Regulations (fines up to N$10 000 and/or equipment seizure).With this, we propose the implementation of stricter noise regulations for sports clubs and commercial properties situated and operating in residential areas like Pionierspark residential area. These regulations should include limits on the decibel levels for music and public announcements, as well as restrictions on the timing of noise-producing events. By working with local authorities, we can ensure that businesses operate responsibly without infringing on the rights of residents to a peaceful home life. We believe that by setting realistic noise standards, we can achieve a balance that respects both business operations and residential tranquility.
