Sarina Sherinda Cloete (39) wat na bewering haar man verlede Desember by Rundu vermoor het, is borgtog van N$5 000 toegestaan na \'n appèl teen die Rundu-landdroshof wat haar borgtog geweier het.

Cloete word daarvan beskuldig dat sy haar man, wyle Petrus Cloete, met wie sy 15 jaar getroud was, vermoor het.

Na bewering get sy haar man met \'n besemstok en \'n elektriese draad vermoor.

Die beweerde moord het op 26 Desember naby Sarasungu by die polisiehuise langs die rivier naby Rundu plaasgevind.

Wyle Petrus is na die Rundu-staatshospitaal gehaas, maar het later daardie dag aan sy beserings beswyk.

Ten tyde van die voorval is Cloete, wat voor landdros Selma Shiiga in die Rundu-landdroshof verskyn het, borgtog geweier en die saak is tot 6 Maart uitgestel vir verdere ondersoek.

In haar getuienis het Cloete gesê dat Petrus twee keer binne hul huis op \'n nat vloer en een keer buite op \'n sanderige en klipperige oppervlak geval het. Sy het ontken dat sy die stok of elektriese koord gebruik het om hom leed aan te doen en het volgehou dat die beserings wat tot sy dood gelei het, per ongeluk was.

Aangesien die Rundu-landdroshof haar egter borgtog geweier het, het sy haar tot die Windhoekse hoërhof vir ingryping gewend.

Haar kennisgewing van appèl is op 10 Januarie deur prokureur Bernhard Tjatjara ingedien, wat die hof meegedeel het dat Cloete \'n geskikte kandidaat vir borgtog was, met die argument dat die staat se saak op hoorsê-getuienis gegrond was.

Gegrond op die argumente van Cloete, het die hoërhofregters Herman January en Claudia Claasen, saamgestem dat Cloete \'n geskikte kandidaat vir borgtog is en het hulle landdros Shiiga se beslissing tersyde gestel.

\"Die appellant word borgtog van N$5 000 toegestaan op die volgende voorwaardes,\" lui die uitspraak.

“Die appellant moet haar paspoort, indien sy enige het, aan die ondersoekbeampte oorhandig en moet geen reisdokumente of paspoort verkry of daarvoor aansoek doen totdat hierdie saak afgehandel is nie. Die appellant moet haarself een keer per week tussen 08:00 en 18:00, by die ondersoekbeampte by die Otjimuise-polisiekantoor aanmeld.

“Die aansoeker word nie toegelaat om die Windhoek-distrik te verlaat sonder die skriftelike toestemming van die ondersoekbeampte of die stasiebevelvoerder nie.”

“Die aansoeker moet nie inmeng met staatsgetuies of met polisie-ondersoeke nie. Die appellant moet die hof bywoon op die datum waarop haar saak terugverwys word en elke daaropvolgende datum van uitstel daarna. Die saak word van die rol verwyder en as afgehandel beskou.”

Sarina Sherinda Cloete (39) who allegedly murdered her husband in Rundu last December has been granted bail of N$5 000 following an appeal against the Rundu Magistrate’s Court which denied her bail.

Cleote stands accused of murdering her husband, the late Petrus Cloete whom she was married to for 15 years.

It is alleged that she murdered her husband with a broomstick and an electric wire.

The alleged murder occurred on 26 December near Sarasungu police river houses in Rundu.

The late Petrus was rushed to the Rundu State Hospital but succumbed to his injuries later that day.

At the time of the incident, Cloete who appeared before Magistrate Selma Shiiga at the Rundu Magistrate’s Court, was denied bail and the case was postponed to 6 March to allow for further investigation.

In her testimony, Cloete stated that Petrus fell twice inside their home on a wet floor and once outside on a sandy and rocky surface.

She denied using the mop stick or electrical cord to harm him and maintained that the injuries leading to his death were accidental.

However since the Rundu Magistrate’s Court denied her bail, she turned to the Windhoek High Court for a remedy.

Her notice of appeal was filed by lawyer Bernhard Tjatjara on 10 January who informed the court that Cloete was a suitable candidate for bail arguing that the state’s case was based on hearsay evidence.

Based on the arguments made by Cleote, High Court judges, Justice Herman January and Claudia Claasen concurred that Cloete is a suitable candidate for bail and set aside magistrate Shiiga’s decision was placed aside.

“The appellant is granted bail in the amount of N$5 000 on the following conditions,” the ruling reads.

“The appellant must hand her passport, if she has any, to the investigating officer and should not obtain or apply for any travelling documents or passport until the finalization of this case. The appellant must report herself once a week, between the hours of 08h00 and 18h00 to the Investigation Officer at the Otjimuise Police Station.”

“The applicant is not allowed to leave the district of Windhoek and area of the Municipality of Windhoek without a written permission from the Investigating officer or the station commander.”

“The applicant should not interfere with state witnesses or with police investigations. The appellant must attend court on the date that her case is remanded to and every subsequent date of postponement thereafter. The matter is removed from the roll and regarded as finalised.”
